Avex Group Holdings Inc.
Concerning the Charity Event by JUNSU/JEJUNG/YUCHUN
There was an announcement on April 5 this year, that JUNSU/JEJUNG/YUCHUN (exclusive artists of our company, hereinafter named “JJY”) will hold a charity support event (hereinafter called “this event”) for the Tohoku Kanto Earthquake Disaster.
This event was planned without receiving any permission from our company, which holds the exclusive management rights for JJY in Japan.
Our company has protested multiple times to the organizer ZAK Corporation (hereinafter named “ZAK Corp”) and JJY’s Korean management company, C-JeS ENTERTAINMENT, Co.ltd (hereinafter named “C-Jes Corp” ). However, they have not listened to our protests, and forced through with the ticket sales unilaterally.
Concerning our company’s above handlings, we have received many comments and requests from JJY fans that this event should push through. Or, that since the sole purpose is for charity, we should especially dissolve the exclusive contract. On the other hand, we have received protests from multiple antisocial forces. Furthermore, we were under duress that our president should be harmed, etc.
However, our company holds the exclusive rights for JJY’s activities in Japan, and we have just taken actions for the infringement rightfullly and properly.
Additionally, as we have announced in our press release of September 16 last year, there remains to be compliance problems such as the criminal record of the President of C-JeS in assaulting/blackmailing an artist (of whom he was in charge of). Moreover, the exclusive contract declaratory judgment is still going on in Korea. Therefore, we have no other choice than to suspend the activities of JJY until these are settled.
In spite of the above circumstances, ZAK Corp and C-JeS have in their joint names, and, as ZAK Corp by itself, have filed two provisional dispositions against our company to the Tokyo District Court, claiming that our company’s handlings have no legitimate basis.
Hereafter, our company will contend our legitimacy at the judicature.
Our company does not think that the JJY members themselves are aware of everything that is happening.
Our company wishes that the JYJ members will understand the situation correctly and the real intention of our company.
Additionally, as we have been consistently commenting, our company long for the day where the compliance and legal problems in Korea will be resolved, and that our company can once again manage JJY. Furthermore, to resume the artists’ activities as Tohoshinki . We will do our best in the future.
For the fans who support JJY, we understand that we are making all of you worry.
We appreciate your kind understanding on the above.

I’m with you on this one. I really hope that JYJ aren’t following C-Jes blindly – meaning there isn’t full disclosure. I too wait to see the outcome of this one

Worry? No, that is not the word. We are angry. We are angry and tired with all the excuses and explanations.
Like I said, it seemst hat Avex has a reason for the cancellation but it’s still absurd. I mean, the event was for charity, for Japan for God’s sake, it was not for JYJ to gain more money.

I do think they have a point :/ Whether it’s a charity concert or not … If Avex still has the management rights … This is blatant infringement.
I hope this situation won’t get JYJ into trouble … I wish I could just wipe away all the shady business going on in the background and let the guys shine on stage and be happy T.T

Yes, I am aware of the fact that Avex hasn’t done any management and I, too, find it unfair that when they don’t want anything to do with JYJ, their contract is suspended and all of a sudden it’s like ‘Oh, we’re still their management’ … BUT a contract is a contract and fact is, they are still their management company in Japan whether they act like it or not. C-JeS can’t just go infringing it without consequences. That was what I meant.

i understand some point of the fans….. lawsuit? its tiring right? but their fighting for their right as a singer….avex is the one who make this mess in the first place you know why? cause their to greedy….they are afraid of losing artist from sm so they sacrifice JYJ just to please sm.. their the one who break the contract not JYJ…

So what if JYJ wins the lawsuit and choose to continue be under management with CJES?
Does that means Avex will still not handle them cos 1 person in the company have a criminal record?
or does that means if they win the lawsuit,they’ll also be able to suspend the contract with Avex?
After all that Avex have done to suspend them from Japan,i’d rather hope the JYJ members leave that company than to suffer under them.

Then just let them go already! Dissolve the contract! Why not allow them to promote, anyway? If they still are in contract with JYJ, it doesn’t make sense that they’re blocking them. They’re still entitled to part of JYJ’s income with the past DVDs they’ve released, aren’t they? Blocking JYJ is like losing the money they could’ve earned when they promote them. Simple solution. JYJ would be happy, Avex would be happy, the fans would be happy. I seriously don’t understand this decision.
…Then again, if they’re affiliated with SM, could be part of this whole conspiracy… Damn, I’m tired of all this.

So to Avex, the contract is good as long as it involves stopping JYJ activities and selling JYJ products. But for JYJ to do anything, it isn’t good enough.

Why can’t they continue JYJ’s activities while the lawsuit is going on? Avex continued to promote JYJ for months after they filed the lawsuit, so it doesn’t seem like there’s a legal reason preventing them from promoting JYJ. I wonder if the ruling on the validity of SM’s contract with JYJ will affect the validity of their contract with Avex, or if JYJ’s contract with Avex is completely separate.

In any disaster, we need help ,charity- in this JYJ is giving a concert to help the victims, I think is the most logical and meaningful thing to do. If the concert is kick-off it may be the Ultimate concert in Japan and SM or Avex or those companies is not having the “cake ” because they drop JYJ in the first place. Charity should not have any boundary .JYJ is a young talened musicians, artistes-telling them that doing charity is not correct -I don’t understand the society enough!!

I can’t say I trust SM or AVEX, it’s all about money but saying frankly I do not trust CJES CEO either. All these words of his criminal past always disturb me and all the time I’m afraid he would have a negative impact on the boys’ image. I wish they would create an agency of their own.
