AVEX official gave an official stand related to the chaotic/confusion among TVXQ fans both in Korea and Japan which has been happening after the article about TVXQ already stepped on disbanding procedure was released by Japanese newspapers.
On the 3rd, Nikkan Sports Japan quoted Japanese official from AVEX company, “The policy of TVXQ to work as five members doesn’t yet to change.”
However, as been informed, TVXQ contract with their Japan company AVEX will expire in June. If the contract is not extended from now on, whether TVXQ can continue activities in Japan, it won’t be yet secured.
Currently TVXQ Changmin and Yunho still remain under SM Entertainment while the rest members Jaejoong, Yoochun, and Junsu have left expanding their each individual activities.
Just sometime ago, in Japan TVXQ attended NHK’s year-end award festival Kouhaku Uta Gassen as five members for the first time, however the three members, whose provisional disposition application to terminate exclusive contract against SM Entertainment was accepted by the Korea court as the issue of court injunction, seem to be more passionate in the performance and there was an unseen tense and emotional conflict with the remaining two members that makes the current situation is impossible to predict.
The problem now is whether SM will extend the contract of the 3 members with AVEX after June. The fact that currently TVXQ is at their peak of popularity in Japan is something that can not be ignored under any condition especially in relation to revenue circumstances.
TVXQ is now in a situation of an attempt to reach into final decision amicably to be able to work together in a long-term in Japan.

All the possibilities aside, from my understanding, the situation now is back from the very start. Both sides (SM and 3 members) are not being too aggressive anymore and they try to sit down once more, talking to solve the problem.
Let’s wish they can settle this soon. All the curses/lawsuits against SM won’t help anything at this point, in my opinion. They’re now trying to get a win-win solution and let’s just sit back and don’t ruin the atmosphere

I totally agree with you. I mean, this is serious business. saying “I hate SM” is not going to solve anything except making the situation worse and making the process longer. We should just keep quiet about the lawsuit and keep supporting TVXQ ,in a meanwhile, just let the parties involved deal with the problem because only them knows the real problem and they may come to an agreement ASAP (just praying for that). i feel like the trio will have no problem about the renewal of the contract, i can see that they still want to work as a group in japan, the big problem lies with sm.
Is sm willing to let homin work again with jaechunsu knowing that in terms of money, sm will only have homin’s part and not all the 5 members income. SM is greedy, i can sense they want all or nothing when money is concerned.
with avex’s position, i think they stay neutral for now cuz they don’t have a contract with the members themselves but to sm directly. If sm pulled the plug, avex will have no choice. If avex will hire the trio but homin are not there cuz sm will not allow it, then thsk is still not complete.
SM will be the major player here. Damn it.

i agree, i don’t think sm will just let it slide like that and allow the trio to switch to another agency and still work as dbsk/thsk after. SM’s pride is too big to accept that arrangement. I’m pretty sure sm hate the trio more now cuz of their influence to hankyung’s case.
Lets just hope for the best, and i’m hearing rumors from korea that the trio will start their own company, they will announce it this january. This is just rumor ok.

i think sm and the trio will reach a decision that will benefit all parties: AVEX, SM & TVXQ
remember that the trio didn’t ask for termination of their contraction but rather termination of the exclusive contract.
Therefore even if they are under AVEX, SM will still receive money from TVXQ as whole bcoz the whole conrtact isn’t being terminated like Geng’s from SUJU.
I think SM will still allow them to continue in Japan coz that’s where they make most money and they will still receive cash from them.
The problem in my opinion is not Japan but rather Korea
And i think the article is pointing out that SM will most likely let TVXQ continue due to the main reason which i think is most important to all parties involved REVENUE.
And since its a ecomomic newspaper i take as positive news coz they are pointing out the economic importance of TVXQ and that it plays a vital role in the korean economy.
just have faith that SM will get over their ego coz to me either way itz already tarnished becoz if they disband them it would be the most illogical and dumbest thing a company has ever done letting 100 million USD go down the drain. And the paper is kinda of hinting at that. Itz SM ego that’s in the way and i think they’ll get over it and do the right thing for everyone

Both Avex & SME notice that Tohoshinki will be able to bring lots of cash in 2010. While Avex is trying to keep the boys, SME is trying to torture the boys more.
If SME really want to solve the problem, they had done it long time ago, but they won’t, due to pride & ego, plus they have to pay lots of money to the boys. So, I think, SME will put the boys on hiatus for a long time, & after the public in Korea forget about them completely, they will disband the group.
I know in business point of view, it is a very stupid thing to disband the group that bring half of your income, but it’s not just for a money. If SME agree with the boys, they also have to change all the artists contracts under SME, & it will bring huge financial problem to SME & will lead them to bankruptcy.
If SME let go DBSK, the company might suffer financial problem for 1-2 years but not lead them to bankruptcy.
I do wish that it is possible for Avex to hire JCS first under Avex after their contract is expired in June, than Homin, after they finished all their commitments to SME.

i am not clear about this part, so if someone can clarify.
i am under the impression that they ARE still under SME. they were trying to dissolve the exclusive part of their contract, not the entire contract. so, is it accurate to say that they have left?
and someone else said they wish avex can hire jcs first when their contracts expire in june, but that would not be possible as just a trio when they are still technically under SME right? it’s either 5 or nothing.

Not exactly left SME. They are still under SME.
Just that they are able to pursue individual activities and any activities with SME has to be agreeable by the trio.
Think the complication now is that the name Tohoshinki is between SME and Avex. Since SME don’t allow them to attend personal activities with TVXQ name, it will be a complication if Avex employ them separately.
And I think the boys still wants to remain as TVXQ/Tohoshinki/DBSK.

I think its just the fact that Ho Min didnt get as much solo lines in SBU as the other three, the media just tries oversensationalize stories and make it seem like Ho Min “less passionate” in singing. I dont believe they are less passionate, they are just probably tired, sad( since they are probably the first to know that avex contracts expires in june unless SME and jaechunsu can come to an greement, if not, the whole dbsk is at stake and it will affect Ho Min too because Ho Min also love singing and and love dbsk so much). i agree that other companies do want the trio but i doubt they will be able to carry the name dbsk with them. it will be very controversial with cassie not wanting to split the boys up. sm certainly will not let the five of them work together if tey r in different companies. sm have too muc pride.

That’s why the rumors dated the Sayonara Concert in June. I was thinking, what is the significance of June? I guess we now have the answer, June is the date of the expiration of the AVEX contract.
I don’t think the trio can enter into contract with AVEX separate from the other two, it has to be through SM because it does not constitute individual but group activities. The contract of SM’s talent, TVXQ, may expire by June but the partnership contract between SM and AVEX may have not.
Will SM renew it? I think they will but it will be on their terms. Sad to say, the inroads the trio made in Korea regarding their individual activities will not be applicable in this instance. They have to nullify their whole contract and not just the exclusive stipulations if they want to sign with AVEX independent of SM.

I see this as good news too, i believe both sides are indeed negotiating, they say they are negotiating…so i guess we must be patient.I am pretty sure Avex is helping all they can, while i am pretty sure SM is not that stupid to let go of the 3, or not renew the contract with avex, at least now for avex.Their popularity in Japan is a no joke.People who came back from japan for vacation will say THSK is everywhere.Even if SM will renew it on their terms, they still need to follow the law.Anyway the point is, JCS lawsuit is not to get out of the company but they just want a better contract.I am pretty sure both sides would work it out.Most of dbsk fans knew June is the expiry date for the avex contract, the media knew this so its not surprising they did some stupid news.

if homin will continue to perform like that, the depressed mode , then its better to just disband already.
if they are not happy to be with the group anymore, then its fine. No use forcing them for the sake of the fans. And in trio’s solo activities, if they can’t use dbsk’s name while homin can, then whats the use of being with the group. I beliv the trio were badly hurt when sm tarnished their reputation through bad media play and all that statements from homin and their fathers. I’m just being realistic here, if im one of the trio, i don’t think i will have the stomach to join sm again after all thats happened.
i think its time to prepare if disbandment will happen.
Like if syc will continue even if all the members pursue solo careers and how to support all the five even though they disbanded. The fans should prepare the possibility. And seeing homin’s faces in their perfs, i don’t think something good is happening behind the scene.
