Remember last month about the “supposed false rumor” that TVXQ / DBSK / Tohoshinki was breaking up? Well, it seems that information may have actually been true. According to this source, it states that on July 31st 3 TVXQ Members, specifically Micky Yoochun, Jaejoong, and Xiah Junsu filed an injunction against SM Entertainment in the Seoul Central District Court to remove the “non exclusivity clause” in their contract. Yunho and Changmin have decided not to file an injunction. Basically the three of them supposedly had meetings with a Chinese cosmetic company and launched a new cosmetic line called CreBeau. They invested some of their own money and also in turn received some lucrative gifts from the Chinese company as an incentive package for signing up and investing. Some of the rumored gifts includes Micky’s Audi R8 and the townhouse for Xiah’s parents.
SM Entertainment supposedly got wind of this news and because SM Entertainment has the “exclusivity clause” in their contract, SM Entertainment tried to prevent this from happening. Unhappy with this, and already unhappy that they feel they’re being underpaid profit-wise from album sales, you can understand why they’re trying to terminate the “exclusivity clause” in their contracts. There’s also rumors that if a favorable agreement isn’t met, the three will be leaving the group for good. SM Entertainment via phone to one of the Korean news media outlets stated that they are aware of the situation, the board of directors is having an emergency meeting and are discussing what to do. They’ll have an official statement soon.
Wow, this is crazy. I wonder how this will effect their arrangements with AVEX in Japan? This isn’t new for SM Entertainment as they had their problems with H.O.T. in the past. I just hope that this doesn’t result in an actual disbandment and that everyone can come to peace. TVXQ is a very talented group and they shouldn’t break up, they have a great thing going.

I hope this will be sorted out really soon. Official statements from SM or one of the members is truly anticipated.
I just can’t ever imagine DBSK disbanding. Surely if JaeChunSu are gonna sue SM, DBSK activities will be disturbed.

aaah, lawyers will always be lawyers….why in the first place they did not secured the contract before the boys signed? And I think the boys and their parents consulted a lawyer before they let them signed…….specially Yunho whose father is a prosecutor……

T_T i hope they will settle this dispute as soon as possible..i read from other sources that from the total money our boys earn, they only get 20% of it (which will be divided among the 5 of them), and SM will get 80%..too bad; they aren’t being paid well for all their hard work..
i am praying this wont lead to their disbandment..T_T
seriously, this issue bothers me..T_T i feel like cryin now

^ omg..That’s Riddiculous..They should get far more than that..the members of tvxq..are entitled to a fair percent..and they deserve it..through all the hard work and effort over the years..Thats so bad..Makes me so sad to hear that…im praying they work through this together..

So the news that I heard that the boys are the shareholders (5% each of them) of SM entertainment is not true?
If they are the shareholder there is no way that they put a lawsuit to SM entertainment.

i dont want to see them break up.. I hope they dont. They are so talented. Each has their own strong points that made this group so special. I seriously hope this thing will be settled and they can continue with their life and job and everything else. *prays*

okay I don’t meen to scare any one, but I think this may have something to do with the fact they are all suddenly doing solo activities outside of singing and the group.
They could be building there fanbases more and getting ready for a potential split up.
To be honest though, I think the boys are right to do this, they are put through torturous trainings and tours, shows and concerts and get absolutely NO money for it.
I can understand that some people will say ‘But isn’t it enough to do something you love, money shouldn’t matter’ However, when you are put through blood, sweat and tears, language barriers, new countries, car accidents, no privacy and STILL get next to nothing out of it.. I think that is a bit much, for the 5 mins they are singing their hearts out, that’s just too much.
I really hope the boys and SM aren’t stupid enough to have a huge court case which could end there jobs.

Oh my gosh! I totally agree with you.
I can’t wait to hear the boys side of the story because I wonder why Yunho and Changmin aren’t also sueing. The upset of the fans is sure to have an impact on the boys; they care so much aboiut them.

Why can’t SM just be cool about this..?
The boys are getting older, so it’s only a matter of time for them to want to be involved in making decisions about their career and money…
and SM is not a company you want to make enemies with…remember what happened to Shinhwa?? I don’t think SM would let them go that easily without putting up a fight…DBSK of course are the highest paid artist of the company…and I think SM only sees the boys as that…
and 13 years??!! it’s too long for a contract..imagine how old they would be by that time, still being controlled by SM…seeing how much the boys suffered and worked so hard to be where they are now…I’m sure every fan would agree that they deserve to be treated better and actually see the fruits of their labor, their money of course..
after reading all this I can’t help but think how admirable JYP is..Rain(Bi)’s contract ended after five years and decided not to renew and started his own company…and even though Rain was JYP’s highest earning artist, he still let him go with no ill feelings..cuz he said he saw Rain as a brother not just an artist that works for him..SM should take note..

3 of them are just asking for changes in their contract. Official statements by their attorney say they get 10% and sometimes 20% what they make and their company gets 80% to 70% of what they make.
Specific details as to the changes to be made are not revealed, but what we know now is that compared to other companies sm artists are basically on slave contracts.
they are not requesting to disband and probably just want to be able to use their names in the companies that they invested in as well. That could be why only 3 and not 5 are filing.
Basically, the 3 people filing and statements by sm and their attorney is all that are facts.
Everything is are just rumors and gossip.
